Our Policy
I, the undersigned, have enrolled myself and my dog(s) in dog training classes, board and trains, private consultations, workshops or other related activities (hereinafter called “Training Services”) offered by The Art of Dogs, LLC.
By signing hereunder, I certify that I have been informed and understand that there is always some unavoidable risk of injury involved when working with animals, especially animals with behavioral issues. I acknowledge that dogs can be inherently difficult to control and that not all dogs will be under control at all times resulting in the possibility of injury to myself, my dog, my family members, or third parties. Additionally, I have had full opportunity to discuss all concerns I have about the foregoing risks with The Art of Dogs, LLC and its authorized representatives. I have also made all inquiries and investigations to my satisfaction related to such risks, including, but not limited to, an examination of the training area (if applicable).
I hereby accept and assume, without reservation, all risks associated with my participation in the training services, including, but not limited to: the risks of any and all injuries to myself, my dog and any of my family members or third parties who may attend; the risks that my dog may cause injury to other persons and/or dogs involved in the Classes; and the risks that saliva, water, food, snow and/or other debris may be present in the training area. I have read and understand The Art of Dogs, LLC’s Terms & Conditions (next page), and agree to abide by them to the extent applicable.
As lawful consideration for participating in the training services, I, for myself, my heirs, executors, administrators, legal representatives, successors and assigns (hereinafter called the “Releasing Party”), hereby waive, release, discharge and agree not to sue and to indemnify, defend and hold harmless The Art of Dogs, LLC and their members, managers, agents, contractors and employees (the “Released Party”) from any and all injuries, losses, claims and damages to any person or persons of any nature whatsoever, including claims arising from the Released Party’s own negligence, and all costs associated therewith, including attorney’s fees, court costs and consultant fees, arising from my participation in the training services.
In the event my dog experiences any medical issues or problem while under The Art of Dogs, LLC’s care, The Art of Dogs, LLC shall take all responsible steps to contact myself or my emergency contact. In addition, The Art of Dogs, LLC is authorized to take the following actions regardless of whether The Art of Dogs, LLC has been able to communicate with the myself about the medical issue. (1) Take reasonable steps to remedy the medical issues of my dog; and (2) seek additional veterinarian services if, in The Art of Dogs, LLC sole discretion, such services are necessary for the best interest of my dog.
This Waiver of Liability & Informed Consent Release shall be legally binding on the Releasing Party. Should the Releasing Party assert a claim to the contrary to what I have agreed to in this Waiver of Liability and Informed Consent Release, the claiming party shall be liable for all expenses (including attorney’s fees, court costs and consultant fees) incurred by both the Releasing Party and the Released Party. No waiver or modification of any provision herein shall be valid unless expressly agreed to in writing by both the Released Party and the Releasing Party.
Terms & Conditions
Private Lessons & Day Training: All cancellations must be made 48 hours in advanced. If you cancel less than 48 hours prior to your appointment, you will forfeit that lesson and are responsible for paying for the missed session. If you wish to terminate your package of lessons or day training, a refund of 50% of any unused services will be refunded back to you. No refunds will be given to services already rendered. Private Lesson Packages must be used within 6 months of purchase date.
Group Classes: No refunds. No make-ups. If you plan on missing a group class, please notify us, we will do our best to get you the information missed during that week.
Board & Trains: If you wish to cancel your Board & Train Program prior to the start date, you will receive a full refund of your deposit if notice is given 2 or more weeks prior to the planned start date. You will receive a 50% refund of your deposit if notice is given between 1 and 2 weeks in advance and you will lose your full deposit if notice of cancellation is given within 1 week of planned start date.
Location of Training: Our training takes place in a wide variety of different locations. While your dog is in The Art of Dogs' care, we train your dog at our facility in Hyde Park, at Anneliese's residence in Rhinebeck, out and about in the greater Hudson Valley and the surrounding areas, and more. We do occasionally make trips out of town that are overnight and if your dog will be with us for one of these trips, we will speak with you about these plans.
Equipment: By signing below you are acknowledging that The Art of Dogs utilizes a wide variety of training tools, including: food treats, toy rewards, long lines, harnesses, head halters, slip leashes, Starmark Collars, prong collars, and remote collars. No dog is going to utilize each of these pieces of equipment, but these are the tools in our toolbox and you are signing up for your dog and yourself for how to properly use whatever tools we deem suitable for you, your dog, and goals.
Payment
Payment shall be made in full at enrollment for all services other than Board & Trains. Board & Trains require a 25% deposit at the time of enrollment, 25% due at drop off, with the remaining due at pickup. Personal Checks, which are bounced, will incur a $25 fee. We also use Venmo and Square.
Signature
I hereby consent to my dog being the subject of the photographs and/or audiovisual recording and authorize The Art of Dogs, LLC to cause the same to be exhibited for educational or marketing purposes as still photographs, transparencies, motion pictures, television, video or other similar media. I hereby release The Art of Dogs, LLC and it’s employees and contractors from any and all claims for damages for libel, slander, invasion of privacy or any other claim based on use of the above-described material(s). Every provision herein is intended to be severable. If any one or more of the provisions herein is found to be unenforceable or invalid, that shall not affect the other terms and provisions hereof, which shall remain binding and enforceable.
